For better or worse, the educational theory that seems to have permeated American education more than any other has been the notion of learning styles. Although the definition can vary, the most popular version of the idea argues that people can be categorized as visual, auditory, or kinesthetic learners. From its earliest origins, though, critics have underscored the very thin and tangled research line that supported the learning styles framework, and in recent years cognitive psychologists have tried to toll the death knell of this approach—without much success. Something about the broader idea of learning styles seems so appealing or persuasive that it continues to shape the thinking of many classroom teachers and parents as well as our own self-descriptions. Thomas Fallace of William Paterson University has written a book titled You Are Not a Kinesthetic Learner: The Troubled History of the Learning Style Idea, tracing the theory from its early origins through a half-century of teaching and thinking about education. He talks with us about whether learning styles actually exist, whether the concept has helped or harmed students, and—if learning styles don’t exist—whether we should just abandon the idea once and for all. The Supreme Court just wrapped the term with a blitz of extremely consequential decisions, and the smoke hasn’t cleared yet. (In fact, it’s looming like a dark storm cloud over our Fourth of July and America 250th festivities…) In this week’s episode, cohosts Dahlia Lithwick and Mark Joseph Stern focus on two of the term’s bleakest legacies: first, the court’s catastrophically bad use of history and second, the demise of independent agencies. They discuss the court’s 6–3 decision in Trump v. Slaughter, which was rooted in shoddy originalism and reckless disregard for how an accountable democratic government actually functions. Meanwhile, the dissenters in Trump v. Barbara would have weaponized bogus history to end birthright citizenship for millions. To unpack this, Dahlia and Mark sit down with two law professors: Sam Bagenstos of the University of Michigan and a former general counsel at the Department of Health and Human Services, and Jed Shugerman of Boston University (whom Justices Sonia Sotomayor and Ketanji Brown Jackson cited this week). They deconstruct the myriad ways in which the high court ultimately embarrassed itself, history, and truth, with decisions that will affect millions of Americans for years to come. Joseph Conrad's Heart of Darkness (1899) is both a scathing critique of European imperialism and a reminder that all humans have the capacity to succumb to the heart of darkness. It also is not without controversy, as people have been debating it's meaning and essence for over a century now. What exactly is the heart of darkness? Was the Belgian Congo a unique circumstance of imperialism or just another example of human nature at work? Is the text of Heart of Darkness a legitimate critique of the imperial mindset, or is it actually just upholding the very norms and imperialistic conventions it is ostensibly dismantling?
